These Terms of Service ("Terms") govern your access to and use of tonesproducts.com, our online store, and related services, content, and features (collectively, the "Services"). The Services are operated by Global Sources USA Corp., doing business as TONES ("TONES," "we," "us," or "our").

By accessing or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.

1. Eligibility and Accounts

You must be able to form a binding contract in your jurisdiction to use the Services. If you create an account, you must provide accurate information, protect your credentials, and promptly notify us of suspected unauthorized use. You are responsible for activity conducted through your account unless prohibited by law.

2. Products and Orders

Product descriptions, images, colors, availability, prices, and promotions may change. We make reasonable efforts to present information accurately, but display settings and production variations may affect appearance. We may limit quantities, reject or cancel orders, correct errors, and discontinue products, subject to applicable law. If we cancel an order after payment, we will issue the appropriate refund.

Orders are offers to purchase and are accepted when we confirm acceptance or ship the products. Taxes, shipping charges, duties, and other fees may apply as disclosed at checkout. Shipping and delivery estimates are not guarantees.

Our Refund Policy and Shipping Policy, as posted on the Services, are incorporated into these Terms.

3. Professional-Use and Product Information

Certain nail products may be intended for trained or professional users. Follow product labels, instructions, warnings, storage requirements, and applicable laws. Stop use and seek appropriate medical advice if an adverse reaction occurs. Information on the Services is general product information and is not medical advice.

4. Acceptable Use

You may not:

• violate law or another person's rights;
• use the Services for fraud, deception, harassment, or harmful activity;
• interfere with security, availability, or operation of the Services;
• introduce malicious code or attempt unauthorized access;
• scrape, copy, reverse engineer, or exploit the Services except as allowed by law or our written permission;
• misuse promotions, reviews, accounts, payment methods, or return processes; or
• use TONES content, trademarks, or product materials in a misleading or unauthorized manner.

We may suspend or terminate access for conduct that violates these Terms or threatens the Services, users, or TONES.

5. User Content and Reviews

You retain ownership of content you submit. You grant TONES a non-exclusive, worldwide, royalty-free license to host, reproduce, display, adapt, distribute, and use that content to operate, promote, and improve the Services, subject to our Privacy Policy and applicable law. You represent that you have the rights needed to submit the content and that it is accurate and lawful.

We may moderate or remove content, but we are not obligated to monitor all content.

6. Intellectual Property

The Services and their content—including text, graphics, product images, videos, logos, designs, software, and trademarks—are owned by or licensed to TONES and protected by law. Except for limited personal, non-commercial use of the Services, no right or license is granted without written permission.

7. Third-Party Services and Platforms

The Services may use or link to third-party services, including payment, shipping, social-media, advertising, and commerce platforms such as Shopify, TikTok, and TikTok Shop. Third-party services are governed by their own terms and policies. We are not responsible for third-party services we do not control.

8. Mobile Messages

If you opt in to TONES text messages, you agree to receive recurring transactional or marketing messages at the number provided, including messages sent using automated technology where permitted. Consent is not a condition of purchase. Message frequency varies; message and data rates may apply.

Reply STOP to opt out and HELP for help, or contact [email protected]. Carriers are not liable for delayed or undelivered messages. Additional disclosures presented when you opt in also apply.

9. Privacy

Our Privacy Policy explains how we collect, use, disclose, and protect personal information. By using the Services, you acknowledge the practices described there.

10. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TONES DISCLAIMS IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE. RIGHTS THAT CANNOT BE DISCLAIMED UNDER APPLICABLE LAW REMAIN UNAFFECTED.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TONES AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, OR LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM THE SERVICES OR THESE TERMS. OUR AGGREGATE LIABILITY WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID TO TONES FOR THE TRANSACTION GIVING RISE TO THE CLAIM OR USD $100.

These limitations do not apply where prohibited by law or to liability that cannot legally be limited.

12. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless TONES and its officers, directors, employees, and affiliates from claims, damages, and expenses arising from your unlawful use of the Services, your violation of these Terms, or content you submit. This section does not apply to the extent a claim results from TONES's own unlawful conduct.

13. Copyright Complaints

If you believe content on the Services infringes your copyright, send a notice containing the information required by 17 U.S.C. § 512(c)(3) to:

14. Governing Law and Venue

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Unless applicable law requires otherwise, the state and federal courts located in Miami-Dade County, Florida will have exclusive jurisdiction over disputes relating to these Terms or the Services, and you consent to their jurisdiction.

15. Changes to the Services or Terms

We may update the Services and these Terms. We will post revised Terms at this stable URL, update the effective date, and provide additional notice where required. Changes apply prospectively from their effective date. Continued use after that date constitutes acceptance where permitted by law.

16. General

These Terms, together with incorporated policies and any terms presented for a specific feature, are the entire agreement regarding the Services. If a provision is unenforceable, it will be limited or removed to the minimum extent necessary, and the remainder will remain effective. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a corporate transaction or by operation of law.
